Location-Based Services

EUND collects a visitor’s geo-location data through the EUND Services for purposes of offering visitors relevant content, including content from nearby Member stations. geo-location data consists of general location information based on latitude and longitude (if the visitor has enabled location services for an EUND application on the visitor’s mobile device), or EUND may approximate a visitor’s location based on the IP address of the visitor’s computer or mobile device.

Children

Children should always get permission from their parents before sending any information about themselves (such as their names, email addresses, and phone numbers) via the web or mobile device, to EUND or to anyone else. EUND does not knowingly allow anyone under the age of 16 to provide any personally-identifying information to EUND. If you are under 16, please do not attempt to register for any EUND Services or provide any information about yourself.

Gathering of Information

EUND collects contact information, such as name, address, email address, and telephone number, that visitors voluntarily submit by, for example, registering for newsletters or an EUND account, signing on to the EUND Services through their social media account, creating a public profile for an EUND account, making a purchase in the EUND Shop, sharing a story, or submitting comments or materials to EUND.

  • EUND collects credit card information provided by EUND Shop customers.
  • EUND’s web server creates access logs for visitors to the EUND Services, recording such information as IP address, date and time of visit, path taken, browser, list of files downloaded or viewed, and time spent listening to audio.
  • EUND collects information from a visitor’s mobile device or app, including unique device identifier, operating system, phone model, app version and/or automobile make (for certain connected car platforms).
  • EUND collects information enabling it to recognise a visitor as the same visitor when the visitor accesses the EUND Services using different browsers or devices.
  • In order to personalise the listening experience for visitors to personalised digital listening services offered through the EUND Services, EUND collects information about each visitor’s listening activity, including audio segments that a visitor listens to, audio segments that a visitor skips and shares, audio segments that a visitor marks as interesting, and listening times and frequency. EUND also collects information regarding whether a visitor has donated to Member stations through the EUND Services, or has requested information about or expressed interest in donating to Member stations. EUND may share this information with the Member stations localised to or associated with a visitor’s account.
  • EUND also collects information about listener interactions with EUND podcasts and other media files, and about the devices and playback platforms used to download and play these files. This information includes descriptions of the episode or file content and embedded sponsorship messages, time and date stamps for download and playback events (e.g., when a particular segment or sponsorship message is played, skipped or paused) and unique listener device and session IDs.
  • EUND may collect information related to content preferences.
  • EUND may collect a visitor’s other personal information (such as age or gender) (a) that the visitor has chosen to associate with the visitor’s social media account(s), or (b) in aggregated, non-identifying form through third-party vendors.
  • EUND uses cookies and web beacons to track certain visitor activity. EUND’s third-party vendors that provide analytics services, provide EUND’s discussion platform, and serve sponsorship acknowledgments also may use their own cookies and web beacons to track visitor activity.

Use of Information

EUND uses the personally-identifying information it gathers (a) to provide requested products and services, (b) to identify visitors when EUND publishes material they submitted, and (c) for internal purposes and for marketing, fundraising, membership and communications purposes of EUND and EUND Member stations.

EUND uses access logs, content preferences, information about visitor listening activity, cookies, web beacons, and third-party analytics data to analyse use of the EUND Services, offer interactive features, and personalise the EUND Services, such as by recalling visitor information so that the visitor does not have to re-enter it, offering local station content or other content that may be of interest to the visitor, and displaying more relevant sponsorship messages. EUND and the Member stations localised to or associated with a visitor’s account also may use information about listening activity and content preferences for internal purposes and for marketing, fundraising, membership and communications purposes.

Sharing Information with Third Parties

EUND generally does not share personally-identifying information it gathers with third parties, except with EUND Member stations, EUND service vendors (to the extent necessary for the vendor to provide the services), and other third parties when a visitor consents. When EUND shares personally-identifying information with EUND Member stations, EUND requires those Member stations to commit to the same restrictions against sharing that personally-identifying information with third parties as EUND commits to in this Privacy Policy.

  • Any information a visitor submits, posts to or shares through the EUND Services will become available to the public.
  • EUND may share with anyone in EUND’s discretion aggregated or other information about use of the EUND Services that does not personally identify our visitors.
  • EUND will release visitor information when required to do so by law or when it believes it is necessary to protect EUND, EUND employees, EUND Member stations, EUND Member station employees, visitors to the EUND Services, sponsors, service providers, the public, or others.
  • If you do not consent to the collection, use or sharing of your personally-identifying information as described in this Privacy Policy, please do not provide that information. By providing your personally-identifying information, you are “opting in” to the collection, use and sharing described in this Privacy Policy.

Full Version of Privacy Policy

At EUND (which refers to EUND and its subsidiary organisations, as applicable), we recognise the importance of privacy to visitors to eunewsdigest.com, EUND’s mobile applications, any other EUND sites, applications and services, and any features of these sites, applications and services (the “EUND Services”). This Privacy Policy explains what type of information is collected from you when you visit the EUND Services and how that information may be used and shared. Please note that this Privacy Policy is separate and distinct from the privacy policies governing the websites, applications and services of EUND’s Member stations, and the websites, applications and services of third parties that may link to or be linked to from the EUND Services.

By using, registering for, or otherwise accessing the EUND Services, you agree to this Privacy Policy and the EUND Terms of Use and you give your express consent (or “opt in”) to the collection, use, sharing and processing of your personal information in accordance with this Privacy Policy. If you do not agree to this Privacy Policy or the Terms of Use, please do not use, register for or otherwise access any of the EUND Services or provide personal information.

EUND may update this Privacy Policy and our Terms of Use from time to time in its sole discretion. Any changes to the Privacy Policy will be posted to this page, with an updated Effective Date noted at the top of the Privacy Policy; visitors to the EUND Services are responsible for reviewing the Privacy Policy for any changes before using, registering for or accessing the EUND Services. Use of the EUND Services constitutes consent to and acceptance of the Privacy Policy and Terms of Use in effect at the time of such use.

Gathering of Information

EUND collects personally-identifying information (such as your name, address, email address, telephone number, and/or credit card information) through the EUND Services for the purposes described in this Privacy Policy.

EUND collects personally-identifying information from visitors whenever visitors provide it to EUND. EUND asks visitors to provide certain personally-identifying information as they interact with the EUND Services, for example: when they register for certain features or services (such as an EUND account, the “EUND One” service, Application Programming Interface (API) content access, and EUND email newsletters); when they create a public profile for their EUND account; when they email, send via SMS (Short Message Service) or text message, or otherwise share a story from the EUND Services; when they make a purchase from the EUND Shop; when they post, upload, transmit and/or otherwise submit (“Submit”) a comment, message, story idea, essay, photo, image, or other text, content or material (“User Materials”); and when they register for an EUND tour or event or any online contest. EUND also may ask visitors to provide personally-identifying information in other limited circumstances specified at the time the information is gathered.

Any information that visitors Submit on or through EUND’s social networking features, forums and discussions, as part of story or blog comments, or that visitors otherwise Submit to the EUND Services, may become public, including the full name and nickname that visitors provide when registering for an EUND account or creating a public profile.

EUND also may collect other personal information (such as age, gender or other demographic information) (a) that the visitor has chosen to associate with his or her own social media account(s), or (b) in aggregated or other non-identifying form through third-party vendors that provide analytics services. This information may be stored on EUND’s servers with other information previously received or collected from the visitor.

In order to personalise the listening experience for visitors to personalised digital listening services offered through the EUND Services (collectively, “EUNDPersonalised Services”), when visitors use EUNDPersonalised Services, EUND collects information about the listening activity of each visitor, including audio segments that a visitor listens to, audio segments that a visitor skips and shares, audio segments that a visitor marks as interesting, and listening times and frequency. EUND also collects information regarding whether a visitor has donated to Member stations through the EUND Services, or has requested information about or expressed interest in donating to Member stations. Within EUND’s mobile sites and applications and any features of these sites and applications (“EUND Mobile Services”), EUND collects a device’s unique identifier, operating system, device model, app version, automobile make (for certain connected car platforms), and/or content preferences.

EUND also collects information about visitor interactions with EUND podcasts and other media files, both when visitors download these files and when they listen to them using the EUND One app. We collect this information through server logs (described further below), as well as metadata containers and code embedded in our audio files that send listening information back to our servers over the Internet during playback. The information we collect in this manner includes IDs associated with the titles and other descriptions of the episodes, segments and sponsorship messages included in the audio file, time and date stamps for download and playback events (e.g., when playback of a particular segment or sponsorship message starts, stops or is skipped or paused), listener device IDs, session IDs and information about the device or platform used to download or play a particular file.

EUND may use a third-party vendor that collects unique device identifiers and any voice-activated action taken by visitors to EUND Mobile Services in response to or in connection with interactive audio sponsorship acknowledgments transmitted through the EUND Mobile Services. This third-party vendor may use this unique device identifier and usage information to deliver targeted sponsorship acknowledgments to the visitor within the EUND Mobile Services. Any unique device identifier and usage information collected by this third-party vendor will be processed and used by this third-party vendor solely to operate its interactive audio sponsorship acknowledgement services. EUND is not responsible for, and assumes no liability for, the privacy and information collection and use practices of this or any other third-party vendor. If you do not agree to the collection and use of this information by EUND’s third-party vendor, please do not engage the interactive audio sponsorship acknowledgement features.

EUND uses Google’s Universal Analytics service to collect information that enables EUND to recognise a visitor as the same user when the visitor accesses the EUND Services using different browsers or devices. See the “Opting Out of Cookies and Web Beacons” section below for more information about opting out of this collection of information by Google Analytics.

Like other web servers, the server used by EUND for the EUND Services automatically creates log files for each visitor who accesses the EUND Services. These “access logs” allow us to make our Services more useful to our visitors. The access logs do NOT record a visitor’s name, address, email address, credit card information, or other similar personally-identifying information. Rather, they contain some or all of the following information:

  • The Internet Protocol address (IP address) of the machine which accessed the EUND Services.
  • General location information (based on IP address or latitude and longitude).
  • Device type and unique device identifier (for users of EUND Mobile Services) and other technical information about your device, system and application software.
  • The date and time of the visit.
  • The path taken through the EUND Services, including any “favorites” selected by the visitor, as well as patterns in the paths taken by visitors.
  • Other content preferences,
  • The browser and operating system being used.
  • A list of files downloaded or viewed.
  • The amount of time spent listening to/viewing media files.
  • Any errors encountered.

EUND also uses “cookies” to collect information. A cookie is a string of characters that can be written to a file on the visitor’s hard drive when the visitor visits a website, application or service. Only the website, application or service that set the cookie can read it, and it can only be used as a record-keeping device to store visitor IDs and information that the site already has. It cannot be used to read other information from the visitor’s hard drive.

EUND uses cookies to track visitors’ activity through the EUND Services, and uses information gathered through EUND and third-party vendor cookies, for purposes including improvement of the site/application/service architecture, offering the visitor interactive features that would not be possible without them, offering local station content or other content that may be of interest to the visitor, recalling specific information to save the visitor time during subsequent visits to the EUND Services, and directing more relevant sponsorship acknowledgments or underwriting credits to the visitor while the visitor is on the EUND Services. For example, cookies allow EUND to remember your registration information while you are logged in. Local station customisation, the EUND Shop, and other interactive features also use cookies.

Third-party vendors that measure and analyse the use of the EUND Services for EUND, provide EUND’s discussion platform and serve sponsorship messages onto the EUND Services also use their own cookies. For example, EUND’s third-party analytics vendors use cookies across multiple sites to collect visitor data (such as data related to age, gender and visitor interests). In addition, EUND works with third-party vendors which may serve sponsorship acknowledgments or other messages to you on other websites after you visit the EUND Services. These third-party vendors use their own cookies to recognise you as anEUND Services visitor and to serve you sponsorship or other messages on other websites that they believe you will find most relevant. This Privacy Policy does not cover the cookies used by these third-party vendors.

EUND and its third-party vendors also may use web beacons, alone or in conjunction with cookies. A web beacon is an electronic image, also known as a single-pixel (1×1) or clear .gif., which can be used to recognise certain information on your computer, such as cookies, the time and date a page is viewed, or a description of where API content is placed. We may use web beacons on this site from time to time for these and other purposes.

Opting Out of Cookies and Web Beacons

If you wish to prevent certain or all cookies from being set to your hard drive or device, or to clear existing cookies from your browser’s or device’s cache, you may be able to disable them in your browser’s or device’s preferences, although your browser or device might then be unable to accommodate certain functionalities on the EUND Services. Visitors desiring to prevent data from being collected by Google Analytics, including user ID information collected through Google’s Universal Analytics service, may use the opt-out browser add-on developed by Google for this purpose.

EUND’s use of personally-identifying information includes the following: managing and administering the EUND Services; responding to visitor messages; providing personalised content; listing name and location (city, state and/or country) information provided by visitors when broadcasting or publishing User Materials; fulfilment of EUND Shop orders; offering access to EUND tours and events; contest management; editorial purposes such as contacting visitors for an online survey; use by EUND’s third-party vendors to operate interactive audio sponsorship acknowledgment services on the EUND Mobile Services; sending EUND email newsletters and other communications, including marketing, fundraising, membership and other communications, from EUND or EUND Member stations to visitors; other internal purposes and marketing, fundraising, membership and communications purposes of EUND and EUND Member stations; and other purposes specified at the time the information is gathered. Any geo-location data and other location information collected through EUND Services is used to offer relevant content, including content from nearby Member stations to the visitor.

Any information that you disclose when participating in the EUND social networking features, forums or discussions (including creating a profile or submitting a comment to a story or blog or in a discussion thread), such as your full name and any nickname, is likely to become public. This information may be posted on the EUND Services and on the platform of EUND’s third-party discussion services vendor. In addition, EUND, its Member stations and their licensees, may use, copy, sublicense, modify, transmit, publicly perform, display, create derivative works of, host, index, cache, tag, encode, and/or adapt any User Materials, and any information contained therein, in any and all media formats or channels, whether now known or hereafter devised, including, but not limited to, the EUND Services, EUND Member station websites and services, other third-party websites and services, over the air (on radio or television), and on mobile platforms. Further, other visitors to the EUND Services may embed a widget or feed that allows your User Materials to appear on their personal, non-commercial website, blog or other application, subject to conditions set forth in the Terms of Use. You also may opt in to sharing your EUND Services profile and comments with other websites and social media platforms, but only by taking action on the website for EUND’s third-party discussion services vendor. Any such action is governed by the terms and privacy policy of EUND’s third-party discussion services vendor, and not of EUND.

In addition, if you send User Materials to EUND through the EUND Services, we may print the User Materials, or an excerpt from the User Materials, on the EUND Services, read them on air, or otherwise publish them in any other medium, together with your name and location (city, state and/or country) if you provide that information to us. EUND may contact visitors regarding their submissions in certain circumstances.

Excluding information provided by the visitor when participating in the EUND social networking features, forums or discussions, or sending User Materials to EUND, which may become public as discussed above, personally-identifying information collected by EUND is not provided to outside parties except EUND Member stations, EUND service vendors (such as EUND Shop fulfilment service, EUND’s email list manager, and the provider of the tool that allows visitors to sign in using information from their account with a third-party service), and other third parties when the visitor specifically consents to such distribution (such as the disclosure of your name to a friend when you email, send via SMS or text message, or otherwise share a story with that friend). EUND may share information about a visitor’s listening activity and whether visitors have donated to Member stations through the EUND Services or have requested information about or expressed interest in donating to Member stations, with the Member stations localised to or associated with the visitor’s account. In these circumstances, the information is provided for the sole purpose of, and only to the extent necessary for, delivering the requested goods to the user, delivering communications from EUND or EUND Member stations to visitors, providing services for and on behalf of EUND, or serving other EUND or EUND Member station internal purposes and marketing, fundraising, membership and communications purposes. When EUND shares personally-identifying information with EUND Member stations, EUND requires those Member stations to commit to the same restrictions against sharing that information with third parties as EUND commits to in this Privacy Policy. Visitors to the EUND Mobile Services should be aware that the wireless carrier for a mobile device or the automobile manufacturer also may collect personally-identifying information and geo-location data. Visitors should check the privacy policies of their wireless carriers and automobile manufacturers for additional information.

EUND also may disclose personally-identifying information if required to do so by law or if it believes that such action is necessary (a) to comply with the law or with legal process, (b) to protect against misuse or unauthorised use of the EUND Services, (c) to protect the personal safety, property or rights of visitors to the EUND Services, the public, EUND and its employees, officers, directors, agents and contractors, EUND Member stations and EUND Member station personnel, sponsors, service providers, and others, or (d) to enforce the Terms of Use.

If you do not want your personally-identifying information to be collected or used for any of these purposes, please do not provide it (although if you do not provide it, you may not be able to use or participate in certain features of the EUND Services). You can also “opt out” from the use of your personal information for certain direct communications purposes by following the process described below in the section titled “Corrections to Registrations; Opting Out of Communications.”

EUND may share with any third parties anonymous information that does not personally identify its visitors. The use and disclosure of such information is not subject to restrictions under this Privacy Policy.

EUND, with the assistance from time to time of its third-party service vendors, uses non-identifying information (in aggregated and non-aggregated form), including non-identifying aggregate data regarding age, gender and/or visitor interests, to analyse use of and better design the EUND Services. For example, EUND may use information to recognise a visitor as the same user when the visitor accesses the EUND Services using different browsers or devices. EUND may share information with third parties in aggregate, non-identifying form as appropriate. For example, we may tell a third party that a certain number or category of visitors accessed a particular audio stream on the EUND Services. We may share non-identifying aggregate information with third-party services that combine EUND’s information with aggregate information from other sources to provide ratings and ranking data or other services of value to EUND. We may share non-identifying information, in aggregated or non-aggregated form, with third-party vendors to help EUNDanalyse and improve the EUND Services. However, we will not disclose any information that could be used to identify our visitors.

EUND also may share information obtained from devices that visitors use to access the EUND Services with certain of its third-party vendors, including its third-party interactive audio sponsorship acknowledgment service provider, for a variety of purposes, including tracking sponsorship acknowledgment credit frequency and voice-activated actions taken in response to interactive audio sponsorship acknowledgments.

We also may share with sponsors, content producers and Member stations information that does not personally identify our visitors, as described in this Privacy Policy.

Security

Under 16: Children should always get permission from their parents before sending any information about themselves (such as their names, email addresses, and phone numbers) via the web or their mobile device, to EUND or to anyone else. EUND does not knowingly allow anyone under the age of 16 to provide any personally-identifying information to EUND. If you are under 16 years of age, please do not send any information about yourself, including your name, address or email address. If we discover that we have collected any personally-identifying information from a child under the age of 16, we will remove that information from our database as soon as possible.

16-18: You must be at least 18 years old in order to Submit any User Materials on or through the EUND Services, register for the EUND Services, create a public profile, participate in any online contests, or place an order on the EUND Shop. Visitors between the ages of 16 and 18 must obtain permission from their parents or guardians before registering for email newsletters or otherwise sending any personally-identifying information.

Corrections to Registrations; Opting Out of Communications

Please contact us to (a) correct or update any registration information that you have provided to EUND, (b) opt-out of future communications from EUND, or (c) request EUND to cancel your EUND account, EUND newsletter registration and other EUND registrations.

Acceptance of Privacy Policy Terms

EUND reserves the right to change this Privacy Policy. Any changes to this policy will be posted to this page, so please check this page periodically. Use of the EUND Services constitutes consent to any policy then in effect. Please make sure that you read EUND’s Terms of Use to understand additional terms and conditions which apply to the use of the EUND Services.

Links to other Sites and Services

It is important to note that the EUND Services contain links to other sites, applications and services maintained by third parties that may not follow the same privacy policies as the EUND Services. For instance, clicking or tapping on a sponsorship acknowledgment or some third-party logos on the EUND Services will take you to an entirely different site, application or service. These sites, applications and services may use cookies, collect data, and use the data in ways that the EUND Services would not. EUND is not responsible for the privacy practices of, or any information or materials on, these other sites. Please visit these sites if you wish to review their privacy policies.

The EUND Services include a tool that allows you to sign in or share content using information from your account with a third-party service, such as Facebook, Twitter, or Google+. Please be aware that those third-party services are unrelated to EUND, and that your use of the third-party services is subject to the terms and policies of those services.

International User Notice

For international users, please note that it may be necessary to transfer your information internationally and, in particular, your information may be transferred to and processed in Europe. For residents of the European Union: the data protection and other laws of other countries outside of the European Union may not be as comprehensive as those of the European Union. Please be assured that we take steps to ensure that your privacy is protected as described in this policy. By using the EUND Services, you agree to have your information transferred to and used in Europe as set forth in this policy.
